Terms of Use

1. Who we are and what these terms cover

Ironbound Kingdom (“the game”) is published by Kawi Software AS, organisation number933 580 873, Fredrik Meltzers gate 13B, 5007 Bergen, Norway (“Kawi”, “we”). Contact: petter@kawisoftware.com. These terms are an agreement between you and Kawi about your use of the game on iPhone, iPad and Android. By downloading or playing the game you accept them. If you are under the age of legal majority where you live, a parent or guardian should read them with you.

Our privacy policy explains how we handle data. The terms of the store you downloaded the game from (Apple’s App Store or Google Play) also apply.

2. Your licence

We give you a personal, non-exclusive, non-transferable, revocable licence to download and use the game for your own non-commercial entertainment on devices you own or control, as allowed by the store’s rules (for Apple devices, the Usage Rules in Apple’s Media Services Terms and Conditions, including Family Sharing where it applies). The game, its story, art, music, characters, names and code belong to Kawi and its licensors; you get a licence to use it, not ownership of it.

3. Fair use

Please do not: copy, sell, rent or redistribute the game; reverse engineer or modify it, except where the law allows you to; use cheats, automation scripts or modified versions to obtain items or purchases you did not earn or pay for; or use the game to break the law. We may stop providing the game or parts of it to anyone who seriously breaks these rules, as far as the law allows.

4. The game, your progress and updates

The game is single player. Your progress is stored on your device; in version 1.0.0 there is no account and no cloud backup, so deleting the game or losing your device can lose your progress. We may update the game to fix problems, add content or change balance, and we may need you to install an update to keep playing. We will not remove content you paid for while you have the right to use it, except where the law allows or where we give you an equal replacement.

5. In-game currency and items

Gold, Embers, Throne Seals, items, gear and looks are parts of the game, not money or property. They have no cash value, cannot be exchanged for money, cannot be transferred or sold outside the game, and can only be used in the game. Embers never expire. Embers buy looks and decorations; they never buy combat strength, maps or story. We may change how items and currencies work in the game when we update it, but we will not take away items or Embers you have, except to correct a clear error or abuse, or as described in section 9 when a store reverses a payment.

6. Free to play

Version 1.0.0 is free to download and play and offers no purchases. Embers in version 1.0.0 are earned only by playing and are spent at Wynn’s Supply.

Sections 7 and 8 apply once purchases are offered in the game. Version 1.0.0 offers none.

7. Purchases

  • Sellers. In-app purchases are sold and charged by Apple (App Store) or Google (Google Play), under their terms. The price is the one the store shows when you buy, including any tax the store adds. We never see your payment details.
  • Delivery. Purchased Embers and items are delivered to your game at once. Looks, the Starter Satchel’s permanent parts, a Rebellion Ledger premium track and subscription benefits are tied to your store account and can be restored with Restore purchases (in Settings > Account and in the shop). Consumable purchases (Embers) cannot be restored by the store: they live in your saved game, so keep your progress safe with the optional cloud backup and recovery code (Settings > Account). If a purchase does not arrive, contact support with your Player ID.
  • Age and limits. Players under 18, and players who prefer not to say their age, have spending limits that a parent can change behind a parent gate; for players under 13, purchases are off until a parent turns them on. Parents can also use the parental controls of their device and store.
  • Rebellion Ledger. A premium track belongs to one season. It unlocks the premium rewards of every tier you reach in that season, including tiers reached before you bought it. When a season ends, every reward you earned but did not claim is sent to your Mailbox. A season’s dates are shown in the game.
  • Nothing random is sold. No purchase contains random rewards; what a product contains is shown before you buy.

8. The Emberwick Charter subscription

  • What you get. The Charter’s benefits are listed in the game before you buy (for example longer offline work for Auto and Mira, an extra work zone, bag and chest space, Embers when a paid period starts and each day you claim them, and a Charter look for each paid month, which you keep). The benefits apply while the subscription is active.
  • Price and period. Monthly or yearly, at the price the store shows when you subscribe. Payment is charged to your App Store or Google Play account when you confirm the purchase.
  • Automatic renewal. The subscription renews automatically at the end of each period at the then-current price unless you cancel it at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
  • Cancelling. Cancel at any time in your App Store or Google Play account settings (in the game: Settings > Account > Manage subscription). The benefits stay until the end of the period you paid for. Deleting the game does not cancel a subscription.
  • Free trial. If a free trial is offered, it is shown before you subscribe, it is for new subscribers only, and it turns into a paid subscription unless you cancel at least 24 hours before the trial ends. On the App Store, any unused part of a free trial ends when you buy a subscription.
  • Price changes. If the price changes, the store tells you in advance and, where the law or the store requires, asks for your consent before you pay the new price.
  • Changes to benefits. We may add benefits. We will not reduce the benefits of a period you have already paid for; if we must change them later, we will tell you in the game in advance so that you can cancel before the next renewal.

9. Refunds, reversals and your right of withdrawal

  • Refunds are handled by the store that sold the purchase, under its rules and your statutory rights: for the App Store at reportaproblem.apple.com, for Google Play at Google Play’s refund page. This includes unused Embers you bought, which you can ask the store that sold them to refund.
  • Right of withdrawal (EU/EEA and UK consumers). Your right to withdraw from a purchase of digital content within 14 days, and any loss of that right once the content is delivered, is handled by Apple or Google as the seller, under their terms and the law. Kawi does not ask you to give up that right, and nothing in these terms limits it.
  • Reversals. If a store refunds or reverses a payment, the purchase’s ongoing benefits (such as a subscription or a premium track) stop. Items already used or spent are not taken back.
  • Your statutory rights. Nothing in these terms limits rights you have under consumer law that cannot be waived, including your rights if the game or a purchase is faulty or not as described.

10. Warranty and liability

We make the game with care, but it is provided as it is and as available, as far as the law allows. We do not promise that it will always be available, free of errors, or compatible with every device. To the extent the law allows, Kawi is not liable for indirect or consequential losses, or for loss of progress caused by deleting the game, a lost device, or a device backup. Nothing in these terms excludes liability that cannot be excluded by law, such as for death or personal injury caused by negligence, or for fraud.

11. Changes to these terms, law and disputes

We may change these terms when the game or the law changes; the date at the top shows the current version, and we will tell you in the game about important changes. These terms are governed by Norwegian law. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your own country’s courts. Please contact us first so that we can try to solve the problem; EU consumers can also use the EU’s online dispute resolution information.

12. Apple App Store terms

If you downloaded the game from the App Store:

  • These terms are between you and Kawi only, not Apple. Kawi, not Apple, is solely responsible for the game and its content.
  • Your licence is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in Apple’s Media Services Terms and Conditions, except that the game may be accessed by other accounts in your Family Sharing group or through volume purchasing.
  • Kawi, not Apple, is solely responsible for maintenance and support (contact: petter@kawisoftware.com). Apple has no obligation to provide maintenance or support for the game.
  • If the game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the game; any other claims, losses, liabilities, damages, costs or expenses from a failure to conform to a warranty are Kawi’s responsibility, as far as these terms and the law allocate them.
  • Kawi, not Apple, is responsible for addressing any claims by you or a third party relating to the game or your possession or use of it, including product liability claims, claims that the game fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
  • If a third party claims that the game or your possession and use of it infringes that third party’s intellectual property rights, Kawi, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
  • You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Kawi’s name, address and contact details are in section 1; questions, complaints and claims go to petter@kawisoftware.com.
  • You must also comply with applicable third-party terms (for example your network provider’s) when using the game.
  • Apple and Apple’s subsidiaries are third-party beneficiaries of these terms, and once you accept them Apple has the right to enforce them against you as a third-party beneficiary.
